The petitioner has charged for repeated closure of the fair price shop on the pretext of illnesses suffered by him. The authorities below found that repeated closures had disrupted the distribution of essential commodities and also attested to lack of interest of the petitioner in distribution of essential commodities. The alibi of illness was disbelieved.
Fair price shop dealership is granted for the purposes of distribution of essential commodities to the weakest sections of the society. Public interest of timely and uninterrupted distribution has to prevail over personal interests of the licensee.
The conclusions reached by the authorities below are reasonable and have been entered upon reaching the applicable standards of evidence. Pleadings do not disclose any procedural impropriety. No perversity was pointed out during the arguments.
The writ petition is liable to be dismissed and is dismissed.
