The learned counsel appearing for the appellant filed a memo stating that as he has no instructions, he sent notice to the parties and the registered post was returned with an endorsement that appellant was died and the legal representatives of the appellant also were not turned up.

2.The said memo is recorded. Since the appellant died and so far no steps has been taken, this second appeal is dismissed as abated. No costs.
