The applicant's involvement in offence punishable under NDPS Act is indicated from the investigation papers. The bag which is found from his person is considered as that of the sale proceeds of Ganja in respect of which according to learned Advocate for the applicant only presumption prevails. At this stage, charge-sheet is not filed and the investigation is yet not over and, therefore, the contention on behalf of the applicant cannot be accepted. Application is rejected at this stage without prejudice to the right of the applicant to prefer an Application for bail after filing of charge-sheet.
