Heard learned counsel for the petitioner and Sri Devesh Vikram, learned Standing Counsel for the respondent.
Petitioner is before this Court assailing the impugned order of transfer dated 29.4.2021 passed by the fourth respondent whereby the petitioner has been transferred from Hapur to Azamgarh Range.
Admittedly, in response to the order impugned the petitioner has already been relieved and joined at transferred place. In view of the fact, the Court is of the opinion that no useful purpose would be served in keeping this petition pending on the board of this Court and the ends of justice would merit the same being disposed of with liberty to the petitioner to represent his claim before the competent authority in the first instance.
Accordingly, this petition shall stand disposed of with liberty to the petitioner to approach the competent authority and file an appropriate representation ventilating his grievance within a period of two weeks from today. Subject to that representation being made, the same shall be duly examined and final decision be communicated with expedition and preferably within a period of two months therefrom. All contentions of respective parties on merits are kept open.
