Heard learned counsel for the applicant and learned Standing Counsel.
The applicant is before this Court against the wilful defiance of the order dated 14.7.2014 passed in Writ Petition No.34632 of 2014 (Constable Ashok Kumar v. State of U.P. & Ors.) by which the authority concerned was directed to decide the representation of the petitioner regarding payment of arrears of salary for the period in question.
After the notice issued in the present contempt proceeding, affidavit of compliance has been filed by the opposite party indicating therein that the representation of the applicant dated 16.1.2010 was decided by the higher official on 22.6.2010 and as such the contempt application is misconceived.
Considering the facts and circumstances of the case, the Court is of the opinion that once the representation of the application was decided by order dated 22.6.2010, which has been brought on record through affidavit of compliance dated 05.09.2016, the writ Court order has been complied with much before filing of the contempt application and as such no direction is required to be passed in this contempt application.
The contempt application stands disposed of accordingly. Notices, if any, stand discharged.
