C.Murugesan vs The Chariman

Madras High Court|09 November, 2017

JUDGMENT / ORDER

By consent, this writ petition itself is taken up for final disposal.
2. Heard the learned Counsel for the petitioners and Mr.C.Nandagopal, learned Government Advocate, who takes notice for the first respondent and Mr.T.S.Mohammed Mohideen, learned Additional Government Pleader, who takes notice for the respondents 2 to 4.
3. According to the petitioners, they got married on 21.12.2016 and their marriage was solemnized and registered on 03.01.2017 at Thiruverumbur Marriage Registrar Office. As their marriage is an inter-caste marriage, they had made several representations before the respondents, so as to claim the benefits of Dr.Ambedkar Scheme for Social Integration and as the respondents failed to take any action on their representations, they are constrained to file the present petition.
4. Though the prayer in this writ petition is for a larger relief, the learned Counsel for the petitioners now confines his prayer to the effect that it would be suffice, if the representation of the petitioners dated 13.02.2017 is disposed of by the third respondent, on merits, within a stipulated time limit, for which, the learned Additional Government Pleader has no serious objections.
5. Considering the facts and circumstances of the case and also the limited scope of the relief sought, this Court, without going into the merits of the case, directs the third respondent to consider the representation / application of the petitioners dated 13.02.2017 and pass appropriate orders on its own merits and in accordance with law, after affording due opportunity of hearing to all the necessary parties, within a period of six weeks from the date of receipt of a copy of this order.
