Heard Shri Navin Kumar Srivastava, learned counsel for the petitioner; Shri Suryabhan Singh, learned Standing Counsel for the State respondent no.1 and Shri Satendra Pratap Singh, Advocate for Nagar Palika Parishad, Jaunpur.
In pith and substance, the petitioner is before this Court with a request to issue direction to the respondents to ensure payment of pension as well as entire arrears of salary alongwith interest @ 18% from the month of August, 2020 till the date of actual payment and to decide his application for compassionate appointment in place of his mother late Khurshida Begam within some stipulated time.
Learned counsel for the petitioner submits that the mother of the petitioner was working on the post of Sweeper in Nagar Palika Parishad, Jaunpur. Unfortunately, she died in harness on 02.8.2020. After the death of his mother, the petitioner moved an application dated 09.9.2020 before the third respondent for his appointment on compassionate ground as well as for payment of other retiral benefits, which is still pending. He has confined his prayer only to the relief that his application may be considered by the appropriate authority.
Learned counsel for the respondents very fairly states that in case the aforementioned application/representation is pending for consideration, the same will be considered and decided expeditiously.
In the facts and circumstances, no useful purpose would be served in keeping the writ petition pending for consideration and without adverting on the merit of the case, the writ petition stands disposed of finally with the direction to the competent authority to decide the aforementioned application of the petitioner strictly in accordance with law, as expeditiously as possible and preferably within six weeks from the date of production of a copy of this order before him.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Authority/Official shall verify the authenticity of such computerised copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
