Heard Shri Anil Kumar Chaudhary, learned counsel for the petitioners, Shri Utkarsh Tripathi, learned counsel for the State and Shri Sudhanshu Srivastava, learned counsel for N.H.A.I.
The petitioners claim that their land has been utilized for widening/construction of Highway by the National Highway Authority of India being plot nos. 313 and 304 situated in village Sharoj, Tehsil-Sadar, District-Mau.
In 2016, a notice was issued under Section 3(c) of the National Highway Act of 1956.
The petitioners responded to the notice but nothing happened thereafter.
It is submitted that in this case award has been pronounced and other similarly situated persons have already been paid compensation but the petitioners have not being paid any compensation.
In our considered view no useful purpose will be served in keeping the writ petition pending as a direction is being issued to the respondent no. 2 to consider the claim of the petitioners with regard to award made in respect of their land for which compensation has not been made to the petitioners so far. Such a decision shall be taken by the respondent no. 2 as far as possible within a period of three months from the date a certified copy of this order is filed before him.
With the aforesaid observations, the writ petition is disposed of.
