Supplementary affidavit filed today which is taken on record.
Heard Sri Kailash Nath Singh, learned counsel for the petitioner and Sri P.K. Chauhan, learned Standing Counsel.
The petitioner has purchased a plot nos. 282, 68, 113 situated in village Bhateura, Pargana- Rari, Tehsil-Sadar, District Jaunpur on 22.9.1976 through sale deed.
It appears that proceedings under Section 47-A of the Indian Stamp Act, was initiated by Assistant Commissioner Stamp, Jaunpur- respondent no. 1, which is numbered as Case No. 555 of 2015. The said case was decided ex-parte by respondent no.
1 on 30.9.2015. The petitioner, thereafter, on 25.8.2017 has filed recall application which is annexed on page no. 13 of the writ petition.
The only prayer made by the petitioner is that a direction be issued to the respondent no. 1 to decide the recall application within stipulated period.
Considering the facts and circumstances of the case, the respondent no. 1 is directed to decide the recall application dated 28.5.2017 within a period of six months from today after hearing all the parties concerned, if there is no legal impediment in disposal of the said application.
