Learned advocate Mr.Mahesh Pujara for learned advocate Mr.Ashish Dagli for the applicants seeks permission to withdraw this application with a request that the instant Inquiry Case No.11/10 is pending in the Court of Learned Metropolitan Magistrate, Court No.5, Ahmedabad, whereas another criminal case between the same party viz. Criminal Case No.1117/08 is pending in the Court of Learned Metropolitan Magistrate, Court No.13, Ahmedabad and requests that it would be in the interest of justice for both the sides, if both these criminal cases are tried in one Court.
Permission, as prayed for, is granted and the instant application stands disposed of, as withdrawn with a direction to the Learned Chief Metropolitan Magistrate, Ahmedabad, to pass appropriate order in accordance with law regarding the request made by the applicants for trial of both the cases in any one Court of Learned Metropolitan Magistrate, Ahmedabad, as the parties are same. Direct service is permitted.
