JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE, ANDHRA PRADESH AT HYDERABAD (Special Original Jurisdiction) PRESENT THE HON'BLE SRI JUSTICE P.S.NARAYANA W.P.NO.28984 OF 2009.

.. Respondents ORDER:-
This Court ordered notice before admission on 31.12.2009 and further, this Court also directed respondents to maintain status quo with regard to distribution of scheduled commodities.
2. The writ petition is filed for a writ of mandamus declaring the inaction of respondent No.1 in disposing of the stay petition in the Revision Petition filed by the petitioner aggrieved by the order dated 14.12.2009 in Appeal Case No.D.Dis.E.485/2009 passed by respondent No.2 herein setting aside the appointment order of the petitioner as Fair Price shop dealer of Santhapet of Shop No.29, Nellore city of Nellore Mandal passed by respondent No.3 herein vide D.Dis.No.1120/2009 dated 09.07.2009 as arbitrary, illegal and consequently direct to dispose of the stay petition forthwith and pass such other suitable orders.
3. Several facts had been narrated in the affidavit filed in support of the writ petition.
4. Respondent No.5 filed W.V.M.P.No.69 of 2010 to vacate the interim order. Specific stand had been taken in the counter affidavit of respondent No.5 that the writ petitioner is a student of B.Tech, studying II year and suppressing the said fact, the order of appointment had been obtained.
5. Be that as it may, this Court is not inclined to express any opinion touching the merits and demerits. In the light of the facts and circumstances, let respondent No.1-District Collector, S.P.S.R.Nellore District, Nellore dispose of the Revision itself within a period of two (2) weeks from the date of receipt of a copy of this order. Till then, the interim order of status quo granted by this Court be operated.
6. The writ petition is disposed of accordingly. There shall be no order as to costs.
