Mr.K.P.Raval, learned Additional Public Prosecutor for the respondent no.1-State files a communication from the office of C.P.I., Himmatnagar, addressed to learned Public Prosecutor of this Court, wherein it has been specifically stated that, in the instant matter, since the Investigating Officer found that the dispute was of civil nature, on 30.03.2012, a "C" Summary report has been filed in the Court of learned Judicial Magistrate First Class, Talod.

The instant petition is filed, seeking quashing of M.Case No.16/06. As reported by the Investigating Officer through Mr.K.P.Raval, learned Additional Public Prosecutor for the respondent no.1-State, at the end of the investigation, in the instant matter, the Investigating Officer claimed "C" summary.
In above view of the matter, the cause for the instant petition at present does not survive and accordingly, the instant petition stands disposed of. The communication tendered by Mr.K.P.Raval, learned Additional Public Prosecutor for the respondent no.1-State shall be retained.
