Heard learned counsel for the applicants and learned AGA for the State.
By means of this application, the applicants who are involved in case crime no. 535 of 2017, under Sections 326, 504, 201/34 and 302 IPC, P.S. Haldi, District Ballia, is seeking enlargement on bail during the trial.
Considering the fact that though the applicants are named accused person who were attributed the role of pouring kerosene oil and sitting the deceased Naveen Srivastava ablaze. In 161 Cr.P.C. statement recorded on 11.11.2017, the deceased Naveen Srivastava has given a vivid description of the incident attributing the active role of Chhotu Rajbhar and Rakesh Rajbhar, the applicants. I do not find it a fit case to enlarge the applicants on bail. The bail application of the applicants is hereby rejected.
However considering the peculiar facts and circumstances of the case the trial court is directed to conclude the trial of the applicant within a period of one year from the date of production of certified copy of this order without granting unnecessary adjournments to either of the parties subject to applicants undertakes that he would render fullest cooperation in early disposal of the trial.
Office is directed to communicate this order to the concern court within fortnight from the date of production of certified copy of this order.
