On the matter being taken up today, Shri Vibhu Rai, Advocate appearing on behalf of the opposite party has placed on record the order dated 25.7.2019 passed by the Zonal Officer, Prayagraj Development Authority, Prayagraj wherein the proceeding under Section 28 (2) of U.P. Urban Planning and Development Act, 1973 has been finalized and the matter has been referred to the Prescribed Authority/Sub Divisional Officer, Tehsil Sadar, District Prayagraj. He states that the order of the writ Court has been complied with. The instruction is taken on record and copy of the instruction is given to learned counsel for the applicant.
Consequently nothing further survives and the contempt application is disposed of.
It is, however, clarified that this order shall not preclude the applicant to assail the validity of the said order before the appropriate forum.
