JUDGMENT / ORDER

Mr.Pranav G. Desai, learned advocate appearing on behalf of the respondent Corporation has submitted that a fresh order is already filed under sec.260(2) of the BPMC Act.
Mr.Ashish Dagli, learned advocate appearing for Mr.Nishith P. Thakker, learned advocate appearing on behalf of the petitioner of Special Civil Application No.514 of 2010 has submitted that his client has not received any copy of the order.
Mr.Pranav Desai, learned advocate appearing on behalf of the Corporation has submitted that either it must have been served or it must be in transit and the Corporation will see to it that the said order is served upon the concerned persons within a period of one week from today.
In view of the above, present petition is disposed of accordingly without entering into the merits of the case and without expressing anything on merits in favour of either parties. If the petitioner of Special Civil Application No.514 of 2010 and/or any other person is aggrieved by the fresh order passed by the Corporation, it will be open for them to initiate appropriate proceedings which can be considered in accordance with law and on merits, for which this Court has not expressed any opinion.
