This is a writ petition challenging the notice under Section 13(2) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (the Act).
Ms. Anamika Singh, learned counsel appearing for the respondent-Bank submits that now a notice under Section 13(4) of the Act has also been issued for possession.
That being the case, the petitioner can approach the Debt Recovery Tribunal by filing an application under Section 17(1) of the Act.
In view of the statutory remedy available to the petitioner, we are not inclined to interfere in the matter.
The writ petition is, accordingly, dismissed.
