Heard learned counsel for the petitioners.
The petitioners have preferred this petition for a direction to the court concerned for deciding their Original Suit No.1239 of 2013 (Chanrej Vs. Harendra) pending before him within a stipulated period of time.
The Court is not aware as to the pendency of other old cases before the court concerned. It is not the case of the petitioners that the court is deliberately delaying the disposal of the said case or that the respondents are avoiding consideration of the same.
In view of the above, keeping in mind the ratio of the case of Km. Shobha Bose Vs. Judge Small Causes Court (2010 (1) ADJ 531 (DB), the writ petition is disposed of with liberty to the petitioners to move a proper application for expeditious disposal of the above suit before the court concerned and it is expected that the court will look into the matter and try to dispose of the said case most expeditiously depending upon the pendency of the other old cases by fixing short dates and curtailing all unnecessary adjournments.
With the aforesaid observations, the writ petition is disposed of.
