1. Heard Sri Rahul Kumar Sharma, Advocate, holding brief of Sri Devesh Kumar Sharma, learned counsel for the petitioner and learned Standing Counsel for respondents-State. Notice need not be issued to respondents No. 2 to 10 at this stage.
2. The only relief sought in the writ petition is that partition suit No.523 of 2021 (Chandrabhan vs. Jagannath and Another) under Section 116 of U.P. Revenue Code, 2006 pending since 03.06.2021 before Sub Divisional Magistrate, Mathura, respondent no.1, be directed to be decided expeditiously.
3. Learned Standing Counsel fairly states that in case the aforesaid case is still pending and has not been disposed of, the same will be considered and decided expeditiously.
4. As no useful purpose would be served in keeping the matter pending or calling for counter affidavit, as such, respondent No.1 is directed to decide the aforesaid case, expeditiously, in accordance with law, if there is no legal impediment in deciding the same, preferably within a period of on year from the date of receipt of a copy of this order downloaded from the website of the High Court, after hearing all the parties concerned.
5. Writ petition stands disposed of.
