The instant application under section 482 Cr.P.C. has been filed for quashing of the summoning order dated 27.07.2012 as well as non bailable warrant dated 16.01.2018 issued against the applicant in Complaint Case No. 2201 of 2012 (State Vs. Ram Bahal and others) under section 9, 17-A, 27, 29, 32, 39, 50 and 51 of Wild Life Protection Act, 1972, P.S. Bakhira, District Sant Kabir Nagar.
Learned counsel for the applicants submits that the applicants are willing to surrender before the court below within a period of 15 days.
Without expressing any opinion on merits of the case and in view of the fact that the applicant is willing to comply with the orders passed by the court, if the applicant appears before the court concerned within fifteen days from today and applies for bail, it is expected that the same will be considered and disposed off, expeditiously, in accordance with law in view of the law laid down by the Full Bench of this Court in the case of Amarawati and another Vs. State of U.P., reported in 2004(57) ALR- 390 and by the Apex Court in Lal Kamlendra Pratap Singh Vs. State of U.P. reported in 2009 (4) SCC 437, after giving opportunity to the public prosecutor.
For a period of fifteen days the operation of the summoning order dated 27.07.2012 as well as non bailable warrant dated 16.01.2018 issued Complaint Case No. 2201 of 2012 (State Vs. Ram Bahal and others) under section 9, 17-A, 27, 29, 32, 39, 50 and 51 of Wild Life Protection Act, 1972, P.S. Bakhira, District Sant Kabir Nagar, shall be kept in abeyance.
With these observations present application filed under section 482 Cr.P.C. is finally disposed of.
