Heard learned counsel for the parties.
The writ court vide order dated 25.09.1998 had directed the parties to maintain status-quo as existing on the spot in relation to the chaks in dispute till the next date of listing.
No material has been placed on record to show that the interim order is continuing till date.
In the meantime, the court below has decided the petition under Section 24 of the Uttar Pradesh Revenue Code, 2006, demarcating the disputed property. The mutation pursuant thereof was carried out.
On specific query, learned counsel for the applicant submits that the the applicant is in possession of the disputed property, however, he apprehends that the possession will be taken from him pursuant to the demarcation order.
The submission lacks merit, admittedly applicant is in possession of the disputed property. The remedy available to the applicant is either to assail the final order or get the pending petition decided.
Petition is accordingly dismissed.
