Ref: Criminal Misc. IInd Bail Application No. 129096 of 2017 Heard Sri Sheetala Prasad Pandey, learned counsel for the appellant, Sri A.R. Chaurasia, learned AGA for the State and perused the record.
This is the second bail application on behalf of the appellant. The first bail application of the appellant was rejected by this Court comprising one of us (Justice Ramesh Sinha) and Hon'ble Justice Vinod Kumar Srivastava-III (as he then was) vide order dated 08.04.2016.
The new ground in the second bail application has been argued by the learned counsel for the appellant is that the appellant is languishing in jail for last five years.
Learned AGA has vehemently opposed the prayer of bail and submitted that the first bail application of the applicant was rejected on merit. The present appeal is listed for final hearing and the paper book is ready.
Without expressing any opinion on the merits of the case and considering the submissions advanced, we find that no good ground is made out for enlarging the appellant on bail.
The bail application of the appellant, Chandra Shekhar convicted and sentenced in S.T. No.256 of 2013 (Case Crime No.516 of 2013) (State of U.P. Vs. Smt. Madhuri and others), under Sections 364-A, 120-B I.P.C, police station Munderawa, district Basti, is, accordingly, rejected.
List this matter on Monday i.e. on 17.09.2018 along with connected matters for final hearing at 3:30 p.m.
Sri Sheetala Prasad Pandey, learned counsel for the appellant shall inform Sri Ravindra Prakash Srivastava, learned counsel appearing in connected matter on behalf of appellant about the matter being listed on 17.9.2018 for final hearing so that he may appear in the matter to argue the appeal.
