The writ petition seeks quashing of the First Information Report dated 23.6.2017 bearing Case Crime No. 0595 of 2017 under Sections 498A, 354, 307 and 323 I.P.C. and 3/4 D.P. Act, of Police Station Ghatampur, District Kanpur Shahar. This Court vide order dated 4.8.2017 had directed not to take any coercive action against the petitioners, however, no order of stay of the investigation was granted. This order is operating since August 2017. We are informed that investigation is in progress.
In view thereof, by consent, we dispose of the petition with direction to the Investigating Officer not to take any coercive action against the petitioners during pendency of investigation and till submission of charge sheet/final report, without prior permission of the concerned court.
