Heard Sri Kartikeya Saran, learned counsel for the petitioner and Sri Vikas Budhwar, learned counsel for Hindustan Petroleum Corporation Ltd.
The selection of the petitioner for the retail outlet dealership at the location in question as per the advertisement dated 25.11.2018 has been cancelled by the impugned order dated 9th April, 2019.
The submission is that the aforesaid order is a non-speaking order and assigns no reasons for its cancellation except for vaguely stating that the petitioner is not eligible for the grant of dealership.
Sri Vikas Budhwar, learned counsel on the basis of the instructions submits that the petitioner has filed objections against the aforesaid order and that the same are under active consideration by the Regional Manager (respondent No.2). Therefore, if the Court deems fit and proper, till the disposal of the said objections, the order may be kept in abeyance.
In view of the aforesaid facts and circumstances, we dispose off the writ petition with the direction to the respondent No.2 to consider and decide the objections of the petitioner against the impugned order dated 9th April, 2019 in accordance with law, most expeditiously, if possible within a period of 6 weeks from the date a copy of this order is produced before him and in the meantime, till such disposal, the impugned order shall not be given any effect.
The aforesaid order has been passed with the consent of the parties. The writ petition, accordingly, stands disposed off.
