Heard learned counsel for the petitioner.
The petitioner is the plaintiff in the suit and has come up before this Court claiming following relief as substantial relief:
"To direct the Court below/The court of learned Civil Judge (Aver Khand) Haweli, District Azamgarh to decide the civil suit bearing number 1769 of 2018 (Chandra Dev Ram Vs. Shiv Charan and others) within a short stipulated period fix by this Hon'ble Court."
It is argued that the delay is being unnecessarily caused and therefore, suit may be expedited.
Having heard learned counsel for the petitioner, I find that the suit is of the year 2018 and it is a widely known fact that the State Uttar Pradesh was badly hit initially by the lockdown during the first wave of pandemic Covid-19 and so also subsequently during the 2nd wave of Covid-19 adversely affecting the judicial functions of the courts in the State.
In such above view of the matter, therefore, this Court does not find it feasible to expedite the suit of the year 2018. However, it is expected that the court concerned shall expeditiously dispose of the suit in accordance with law.
The petition is disposed of with the aforesaid observations and directions.
