JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Rule.
Mr. KL Pandya learned APP waives service of rule on behalf of the State.
The present application has been preferred by the applicant-convict for temporary bail on the ground that he wants to have the cataract operation through private doctor.
It appears that the convict has been operated in right eye for cataract on 3.12.2011, but as per the convict, after the operation, his vision is not clear, and therefore, he wants to have the operation at his costs through other private doctor. The jail report shows that earlier whenever he was released,he surrendered in time.
Under the circumstances, the applicant-convict is released on temporary bail for a period of 10 days from the date of his actual release on personal bond of Rs. 5000/- with one surety of the like amount with the further direction that upon expiry of period, he shall surrender before the Jail Authority. The application is allowed to the aforesaid extent. Rule is made absolute.
