Mr.Pandya, learned advocate appearing on behalf of the petitioner seeks permission to withdraw the present Special Civil Application so as to enable the petitioner to prefer an appeal before the appellate authority under the Payment of Gratuity Act, 1972.

Without going into the merits of the case and without expressing any opinion on merits, permission as prayed for by the petitioner is hereby granted. Present petition is dismissed as withdrawn with above liberty.
