Respondent (By Sri.S.Ramesh, Advocate) This writ petition is filed under Articles 226 & 227 of the Constitution of India praying to call for records leading to the passing of the award dated 06.03.2017 passed by the First Additional Labour Court, Bengaluru in Ref.No.27/2014 (Annexure – K).
This writ petition coming on for Orders this day, the Court made the following:
ORDER R. DEVDAS J., (ORAL):
The parties before the Court have filed a Joint Memo of Settlement dated 19.01.2019 whereby, the 16 respondents–workmen, whose dispute has been expoused by the respondent No.1, have agreed to receive lump sum amount mentioned against each name as indicated in the Joint Memo, in full and final settlement of all their claims including the claim for back wages, reinstatement etc. The details of the amount and the cheque numbers have been given in the Joint Memo.
2. Learned counsel for the petitioner today handed over the cheques to each of the individual workmen in the presence of this Court.
3. Out of the 16 workmen 4 workmen namely Sri.Mahadeva, Sri. Maregowder, Sri.Naveen and Sri. Sunil have not appeared before this Court. Therefore, the cheques with respect to the 4 workmen are handed over to the learned counsel for the respondent by the learned counsel for the petitioner. Learned counsel for the respondent undertakes to pass on the cheques to the respondent-workmen.
4. The award stands modified in terms of the Joint Memo of settlement filed by the parties.
Accordingly, the writ petition is disposed of in term of the Joint Memo.
