JUDGMENT / ORDER

K.K.SASIDHARAN,J.
When it was pointed out as to how the Habeas Corpus Petition is maintainable in a family matter, in which, the matrimonial proceedings are pending between the parties and the minors are in the custody of the third respondent, who is stated to be the wife of the petitioner, the learned counsel submitted that he is withdrawing the Habeas Corpus petition with liberty to move the Family Court with appropriate relief. He has also made an endorsement to that effect.
2. In view of the endorsement so made, the Habeas Corpus Petition is dismissed as withdrawn with such liberty. No costs.
