JUDGMENT / ORDER

The learned counsel for the petitioner submitted that the learned Additional Sessions Judge (Mahalir Neethimandram (FTC Mahila Court, Erode), by Order dated 02.05.2017 in Crl.M.P.No.117 of 2017, while granting suspension of sentence to the petitioner imposed one of the conditions to the effect that the petitioner shall deposit a sum of Rs.1,00,000/-(Rupees one lakh only). The learned counsel also submitted that the petitioner is the only bread winner of the family and since he could not mobilse the funds, he could not come out on bail. He further submitted that the condition is onerous and therefore, filed the present petition seeking for the above relief.

2. Heard the learned Additional Public Prosecutor.
3. Considering the facts and circumstances of the case, the condition imposed by the learned Additional Sessions Judge (Mahalir Neethimandram (FTC Mahila Court, Erode) in Crl.M.P.No.117 of 2017 dated 02.05.2017 is modified to the effect that the petitioner shall deposit a sum of Rs.50,000/-(Rupees fifty thousand only) into the credit of C.A.No.96 of 2017, which shall be kept in a bank as deposit until further orders and for the balance amount of Rs.50,000/- the petitioner shall furnish property security within a period of four weeks from the date of receipt of a copy of this order, failing which, the order passed by the learned Additional Sessions Judge (Mahalir Neethimandram (FTC Mahila Court, Erode) in Crl.M.P.No.117 of 2017 dated 02.05.2017 shall take effect without any modification.
