It is alleged that a post of Assistant Clerk has fallen vacant in the institution on account of promotion of one Ravi Kumar Ken, which is required to be filled by direct recruitment, in accordance with law. The Committee of Management has submitted an appropriate application for grant of permission. Submission is that by virtue of regulation 101 framed under Chapter-III of the U.P. Intermediate Education Act, 1921, the Inspector is required to transmit relevant details/facts to the Director and thereafter grant permission, but despite repeated letters sent no decision is being taken in the matter.
Learned Standing Counsel submits that petitioner's grievance shall be examined, in accordance with law.
In the facts and circumstances, noticed above, this writ petition stands disposed of permitting the petitioner to approach respondent no.3, annexing relevant details/facts in respect of existing vacancy against class III post, alongwith certified copy of this order, within a period of two weeks from today. In case such a claim is raised, the Inspector shall act strictly in terms of regulation 101 and after seeking appropriate permission from the Director concerned, he shall pass appropriate orders within a further period of three months thereafter Order Date :- 22.2.2019 n.u.
