It is alleged that 3 posts of Class-IV employees have fallen vacant on 31.5.2003, 31.1.2007 and 31.6.2008 and the Committee of Management has made a request for grant of permission to fill up the post. A reminder has also been sent. Grievance is that the Inspector has not proceeded to pass any order in the matter, so far.
Learned Standing Counsel states that appropriate decision would be taken by the authority concerned, in accordance with law, at the first instance.
Considering the facts and circumstances, noticed above, this petition stands disposed of with a direction upon respondent no.3 to accord consideration to petitioner's claim for grant of permission to fill up the post, by passing appropriate orders in terms of Regulation 101 of the U.P. Intermediate Education Act, 1921, within a period of three months from the date of presentation of certified copy of this order, keeping in view the law laid down by the Division Bench of this Court dated 19.11.2018, in Writ Petition No. 45060 of 2015 (Principal Abhay Nandan Inter College and another Vs. State of U.P. and others).
