Heard learned counsel for the petitioner. Shri Rohit Pandey has put in appearance on behalf of the University-respondent no. 4. Learned Standing Counsel represents respondents no. 1, 2 & 3.
There are three vacant posts in the institution, namely Shri Bhagwan Mahaveer Post Graduate College Pawanagar, Fazilnagar, Kushinagar. This institution is affiliated to respondent no. 4. There arose three vacancies in the institution, i.e. one of Office Superintendent, one of Routine Grade Clerk and one of Library Clerk. The Committee of Management forwarded the papers to fill up the post with regard to permission by the Regional Higher Education Officer. The Regional Higher Education Officer in turn has granted permission for only Office Superintendent, but no orders have been passed with regard to Routine Grade Clerk and Library Assistant.
The writ petition is disposed of with the observation that the Regional Higher Education Officer, Gorakhpur will pass appropriate order with regard to two other posts, as far as possible, within one month from the date a certified copy of this order is presented before it.
