The applicant has preferred the present contempt application for non-compliance and willful disobedience of the judgement and order dated 28.09.2020 passed in Writ Petition No. - 11664 of 2020 (C/M Shri Swami Krishnanand Inter College Vs. State of U.P. and others). The aforesaid order is quoted below:-
"Learned Standing Counsel representing the first respondent states that the report of the Director of Education which is referred to in the petition shall be considered and appropriate action, if warranted, taken. The statement is taken on record.
The petition stands disposed of. "
Learned counsel for the applicant submits that a copy of the aforesaid order was submitted for compliance before the opposite parties by way of Resisted Post on 18.12.2020, copy of postal receipt is appended as Annexure No.4 to the contempt application. It is further argued that subsequently reminder has also been submitted, copy of which is appended as Annexue 6 to the application but the opposite party has willfully not complied with the order thus, has committed civil contempt for punishment under Section 12 of the Contempt of Courts Act, 1971.
Considering the facts and circumstances of the case, the present contempt application is disposed of permitting the applicant to serve a copy of this order along with a copy of the order passed by the Writ Court within a period of two weeks from today. If such the aforesaid orders shall served within the period stipulated above, the opposite party shall comply the order of Writ Court as expeditiously as possible but not later than eight weeks.
With the aforesaid observations, the present contempt application is disposed of.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the applicant alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
