Learned counsel for the petitioner is permitted to implead U.P. Basic Shiksha Parishad, Allahabad as respondent no. 4. Notice on behalf of newly impleaded respondent is also accepted by Sri Arun Kumar.
The District Basic Education Officer, Gorakhpur by an order dated 15.11.2017 has disapproved the selection of the teaching staff made in the institution, which was duly intimated vide letter of the Manager of the committee of management dated 29.6.2016. This order is subject to appeal by virtue of Rule -5 of the U.P. Basic Education Staff Rules,1973. An appeal, in fact, has been filed before the Secretary of the Board on 29.3.2018, which is stated to be pending. Grievance is that neither the appeal is being decided not the authorities are releasing salary to the selected staff.
Sri Arun Kumar, learned counsel for the respondent no. 3 states that the appeal of the petitioner shall be considered by the authority concerned, in accordance with law.
Considering the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon the respondent no.4 to accord consideration to petitioner's appeal, in accordance with law, within a period of three months from the date of presentation of certified copy of this order.
