Petitioner is the committee of management of a recognised and aided intermediate institution which has moved an application before the District Inspector of Schools to grant permission to fill the post of clerk in the institution by direct recruitment, but no decision has yet been taken. The authority concerned is required to act in terms of regulation 101 of the Regulations framed under the U.P. Intermediate Education Act, 1921 and after obtaining necessary permission from the Director, the authority concerned has to pass needful orders.
Learned Standing Counsel submits that petitioner's grievance shall be examined, in accordance with law.
In the facts and circumstances, this writ petition stands disposed of with a direction upon respondent nos.2 and 3 to accord consideration to petitioner's claim, in terms of the regulation 101, by means of a reasoned order to be passed, within a period of three months from the date of presentation of certified copy of this order. The authorities concerned before granting permission shall examine petitioner's claim that class-IV employees are otherwise not eligible for promotion.
