Heard learned counsel for the petitioners and learned standing counsel for the respondents.
This petition under Art. 226 of the Constitution, has been filed seeking a direction to the respondent 2- Secretary, Madhyamik Shiksha Parishad,U.P., Allahabad to allot the Examination Centre for conducting the Board Examination for the 2020 in accordance with the Government Order dated 16.10.2019.
Counsel for the petitioner submits that petitioner-institution was earlier an examination centre for last so many years except 2011-2014 and petitioner-institution applied for making it to be an examination centre for conducting the Board examinations but in the final list of examination centres, name of the petitioner-institution does not find place. The petitioner in this regard has filed an objection/representation on 7.12.2019 which is still lying undecided.
No useful purpose would be served by calling a counter affidavit and keep this petition pending.
Therefore, in the facts and circumstances of the case, this petition is being finally disposed of by issuing a direction to the respondent 2- Secretary, Madhyamik Shiksha Parishad,U.P., Allahabad to decide the petitioner's representation dated 7.12.2019, appended as annexure-3 to the writ petition, in accordance with law expeditiously within a period of three weeks from the date of production of a certified copy of this order.
