Heard learned counsel for the petitioners and learned Standing Counsel appearing for respondent nos. 1, 2 and 5.
Considering the nature of order proposed to be passed, there is no need to issue notice to respondent nos. 3 and 4.
Learned counsel for the petitioners submitted that the dispute under Section 25(1) of the Societies Registration Act, 1860 is pending before the respondent no. 5. The petitioner moved a transfer application on 17.5.2019 before the respondent no.1, but the same has not been decided till date. Lastly, he prayed that a suitable direction may be issued to the respondent no. 1 to decide the application of the petitioner within a short time fixed by this Court.
Learned Standing Counsel has submitted that application of the petitioner shall be considered and decided expeditiously in accordance with law.
Considering the facts and circumstances of the case, this petition is disposed of with a direction to the respondent no. 1 to consider the application of the petitioner dated 17.5.2019 and decide the same strictly in accordance with law after providing an opportunity of hearing to the respondent nos. 3 and 4 within a period of six weeks from the date of production of certified copy of this order.
It is made clear that this Court has not adjudicated the case on merit. It is upon the respondent no. 1 to decide the application of the petitioner after considering the relevant facts as well as rules occupying the field.
