Heard learned counsel for the petitioners and learned standing counsel for the respondents.
This petition under Art. 226 of the Constitution, has been filed for quashing the impugned Final Centre Allotment Report dated 30.11.2019 issued by respondent 4- Secretary, Madhyamik Shiksha Parishad,U.P., Allahabad as the petitioners' Institution has not been made Examination Centre for conducting Boards Examination for the year 2020.
It is contended by learned counsel for the petitioners that the petitioners' Institution is the Girls Institution and they have fulfilled all the requirements as per the Government Order dated 16.10.2019 but the name of the petitioners' Institution did not find place in the final list. it is further contended that the petitioners' Institution filed a representation dated 4.12.2019 before the respondent 4- Secretary, Madhyamik Shiksha Parishad,U.P., Allahabad which is still lying undecided.
No useful purpose would be served by calling a counter affidavit and keep this petition pending.
Therefore, in the facts and circumstances of the case, this petition is being finally disposed of by issuing a direction to the respondent 4- Secretary, Madhyamik Shiksha Parishad,U.P., Allahabad to decide the petitioners' representation dated 4.12.2019, appended as annexure-10 to the writ petition, in accordance with law expeditiously within a period of three weeks from the date of production of a certified copy of this order.
