Heard learned counsel for the petitioners and learned standing counsel for the respondents.
This petition under Art. 226 of the Constitution, has been filed seeking a direction to the respondent 2- Secretary, Madhyamik Shiksha Parishad,U.P., Allahabad to to allot the Examination Centre and to consider and decide the application/ representation of petitioner-institution dated 2.12.2019 for declaring it as an examination centre for conducting Board Examination-2020, within some stipulated period.
It is contended by learned counsel for the petitioners that the Petitioner's Institution applied for the examination centre for conducting the Board Examination for the year 2020 and fulfilled all the criteria as laid down in the Government Order dated 16.10.2019, but in the final list published by the respondents, name of the Petitioner's Institution did not find place. It is submitted by learned counsel for the petitioners that the final list was published on 30.11.2019 and as per Government Order dated 16.10.2019, the name of the petitioner-institution does not find place. The petitioner in this regard has filed an objection/representation on 2.12.2019 which is still lying undecided.
No useful purpose would be served by calling a counter affidavit and keep this petition pending.
Therefore, in the facts and circumstances of the case, this petition is being finally disposed of by issuing a direction to the respondent 2- Secretary, Madhyamik Shiksha Parishad,U.P., Allahabad to decide the petitioner's representation dated 2.12.2019, appended as annexure-7 and 7-A to the writ petition, in accordance with law expeditiously within a period of three weeks from the date of production of a certified copy of this order.
