It is contended that the controversy raised in this petition stands adjudicated by this Court vide order dated 23.2.2018, passed in Writ Petition No.36910 of 2016 (C/M Dwivedi Mahadev Prasad Purva Madhyamik Vidyalaya and another vs. State of U.P. and others).
Learned Standing Counsel as well as Sri S. K. Gupta, learned counsel for the District Basic Education Officer, Deoria does not dispute the aforesaid submission.
For the reasons recorded in the order dated 23.2.2018 passed in Writ Petition No.36910 of 2016, this writ petition is also disposed of on same terms. In order to facilitate a fresh consideration of cause in terms of the aforesaid order, the order passed by the District Basic Education Officer dated 19.5.2018 stands quashed.
