The instant petition has been filed by the Committee of Management of an educational Institution imparting education up to Junior High School level. They have prayed for a mandamus directing the respondents to provide grant-in-aid to the Primary Section, having regard to the provisions of the Right of Children to Free and Compulsory Education Act, 2009, and the judgment of the Apex Court in State of U.P. Versus Pawan Kumar Dwivedi and others, 2014 (9) SCC 692. It is urged that the representation submitted by the petitioners' Institution is pending before the respondents and no decision has been taken so far.
Heard learned standing counsel representing the respondents no.1 & 2 and Sri Vikram Bahadur Singh on behalf of respondent no.3.
Having regard to the facts of the case, the writ petition is disposed of with liberty to the petitioners to file fresh representation before the first respondent and in that event, the first respondent shall pass a speaking order on the representation in accordance with law, expeditiously, preferably within a period of next three months.
