Heard Sri V.K. Singh, learned Senior Counsel for the writ petitioners, Sri Piyush Shukla, learned Standing Counsel for the State and Sri Prabhakar Awasthi, learned counsel who appeared for the respondent No. 8.
The committee of management has challenged an order of single operation which has come to be made with the District Inspector of Schools being constrained to observe that the petitioner committee of management despite repeated entreaties and directions had not handed over the charge of officiating Principal to the eighth respondent, who was the senior most teacher. Sri Singh learned Senior Counsel apprises the Court that subsequent to the passing of the impugned order the eighth respondent has been handed over the charge. He further on instructions states that the committee of management undertakes before this Court not to interfere with the functioning of the aforesaid respondent as officiating Principal. In view of the aforesaid statement and undertaking as noticed above, learned Standing Counsel submitted that the order of single operation may be brought to an end.
In view of the circumstances which have come to the fore post the passing of the impugned order and in light of the undertaking noticed above, the impugned order with the consent of parties shall stand set aside.
The writ petition shall stand disposed of on the above terms.
