Heard Sri Sharad Kumar Srivastava, learned counsel for the applicant and Sri Amrit Raj Chaurasiya, the learned A.G.A.
This is 2nd bail on behalf of the applicant, whose first bail came to be rejected on 31.5.2018.
Learned counsel for the applicant submits that the applicant is the husband, death is on account of suicide and despite an order of expedite dated 31.5.2018 only two witnesses have been examined, coupled with the fact that only dates are being fixed during the entire pandemic period, thus, there is no reasonable likelihood of the trial being concluded in near future, as otherwise applicant is in jail since 23.5.2016, he be enlarged on bail.
Learned A.G.A, opposed the submission.
I do not find any new good ground to enlarge the applicant on bail on a plea of period of detention as the offence alleged is heinous.
The 2nd bail is rejected.
The trial court is directed to expedite trial in the light of order dated 31.5.2018, keeping in view safety guidelines.
Let a compliance report be submitted by trial court in Chambers on 10.5.2021.
