Heard learned counsel for the applicant and Smt. Alpana Singh, learned A.G.A. for the State.
This case has been filed with the following prayer:
"It is expedient in the interest of justice that this Hon'ble Court may graciously be pleased to quash the Charge Sheet No. 207/2020 dated 12.05.2020 as well as entire proceedings of Case No. 166/2020 (State Versus Brijendra Singh Chauhan), arising out of Case Crime No. 138/2020 Under Section 323, 308, 504 I.P.C., Police Station Ajeetmatl, District Auraiya."
An FIR dated 16.03.2020 was lodged under sections 323/308/504 IPC against the applicant and another person. The injury report reflects a lacerated wound muscle deep on top of the skull and the supplementary report says that the injury is grievous and there is a fracture on top of the parietal bone of head. Charge-sheet has been submitted by the investigating officer and cognizance has been taken by the court. There is no material on record to suggest violation of any rule of illegality that may merit interference in this application under section 482 Cr.P.C.
This application is wholly without merit and is accordingly dismissed.
Copy of this application and the order passed today shall be sent to the court below by the office within a week.
