In terms of order dated 20.12.2017 in Writ C No. 61437 of 2017, the Tehsildar, Tehsil Kasiya , district Kushi Nagar, was required to enquire into the allegation of illegal encroachment over Gaon Sabha land and pass appropriate orders in accordance with law, within a period of three months from the date of receipt of certified copy of the order.
Sri K.R. Singh, learned Additional Chief Standing Counsel, on instructions from the opposite party, states that six persons were found in illegal possession over Gaon Sabha land and against whom orders for eviction were passed on 3.4.2018. He further states that on 11.9.2018, three persons out of six were duly dispossessed and the public land was made rid of illegal encroachment. He further states that as against the three remaining persons, the eviction order could not be enforced as an order of status quo is operating in their favour in Original Suit No. 765/2018 and based on the outcome of the civil suit/injunction application, action shall be taken against them.
Having regard to the above stand, this Court is not inclined to proceed any further in the instant matter. The contempt application stands disposed of accordingly.
