Heard Mr. Shiva Priya Prasad, learned counsel for the petitioner and Mr. Raees Ahamad, learned counsel for respondent No. 1.
The only prayer made in the writ petition reads thus:
"(a) Issue a writ, order or direction, directing respondent no 1 in the nature of mandamus to decide the mutation application no 359 (17-18) (Brijbhushan Vs Arun) expeditiously within stipulated time as fix by this Hon'ble court (Annexure 1 to this petition)."
We have perused the application made by the petitioner and the provisions contained in Section 147 (1)(a) of the Uttar Pradesh Municipalities Act, 1916, in particular. Keeping that in view, we direct the concerned authority to consider and decide the petitioner's application, as expeditiously as possible and preferably within a period of twelve weeks from the date of receipt of this order. It is needless to mention that the concerned authority shall follow the due procedure and if necessary to issue notices to all concerned, before deciding the petitioner's application on merits. The petition is accordingly disposed of.
It is made clear that this Court has not examined merits of the case.
