Heard learned counsel for the applicant and learned AGA for the State.
Submission is that the applicant was enlarged on bail on 29.09.2016 by the Trial Court. He absconded from the proceedings and appeared before the trial court on 26.07.2017. The applicant is in jail since then. It has been submitted that the informant and the victim have been examined before the Trial Court and they have been declared hostile. The trial is still proceeding and the applicant may be enlarged on bail at this stage. Learned counsel for the applicant states that applicant will cooperate with the trial.
From the perusal of the record, it appears that on account of absence of the applicant from the proceeding, trial could not proceed. Now the witnesses are being examined. There is no good ground for release the applicant on bail.
The bail application of the applicant is rejected.
Keeping in view all the facts of the case, the Trial Court is directed to conclude the trial of S.T. No. 21 of 2007, Case Crime No.270 of 1992, under Sections 363, 366, 376 IPC, Police Station Kasiya, District- Kushinagar within a period of three months from the date of production of certified copy of this order.
