1. As the affidavit was not filed as per the earlier order passed by this Court vide order dated 25.1.2012, this Court had directed the Chief Officer of Damnagar Municipality to file an affidavit explaining his absence as well as his action of non-filing of affidavit. Pursuant to the order dated 25.1.2012, affidavit in reply is filed. The same is taken on record.

Deepak Sanchela, learned advocate for the petitioner seeks permission to add State of Gujarat as party respondent.
3. Permission is granted. The petitioner is permitted to amend the petition and add State of Gujarat as party through Additional Chief Secretary, Urban Development and Urban Housing Department, having office at Block No.14, New Sachivalay, Gandhinagar and advance copy may be served upon Ms. Hansa Punani, learned AGP. The newly added respondent-State of Gujarat is also directed to file affidavit in reply by 29.2.2012.
