Heard learned counsel for the applicants and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed to quash the charge sheet dated 21.10.2018 in case crime no. 218 of 2018 under section 506 I.P.C. and section 3(2) of SC/ST Act and section 67 I.T. Act P.S. Simbhwali District Hapur and cognizance order dated 3.12.2018 passed by Sessions Judge, Hapur and entire proceedings of Special S.T. No. 58 of 2018(State Vs. Bindu and others) Learned counsel for the applicants submits that no evidence against them has been collected by the Investigating Officer. The victim was consenting party with co-accused Ajay. They have been falsely implicated by the police under the alleged sections.
In that view of the matter, they are permitted to move discharge application within one month from today through counsel before the trial Court and the trial court shall decide the same within a period of two months from the date of filing of application along with certified copy of this order.
Till the discharge application is decided, no coercive measures shall be taken against the applicants.
With the aforesaid direction,the application is disposed of.
