Heard the learned advocate for the applicant and the learned A.P.P for the State.
2. After the order of Sessions Court dated 20.4.2010, Charge sheet has been filed on 30.4.2010 and, therefore, this application is treated as post-charge sheet application.
3. Following aspects are considered :-
(i) Allegations against the applicant are of having uttered certain offending words amounting to offence punishable under Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and criminal intimidation;
(ii) There are no criminal antecedents against the applicant.
3. Considering the above aspects, the application deserves to be allowed and the same is allowed. The applicant is ordered to be released on bail in connection with Crime Register No. I. 44/2010 of Khambhat Rural Police Station, on his executing a bond of Rs. 10,000/- (Rupees Ten Thousand only) with one surety of the like amount to the satisfaction of the lower Court, subject to such conditions which the lower Court may deem fit to impose.
4. Rule is made absolute.
5. Direct Service is permitted.
